General Terms and Conditions

1. These General Terms and Conditions form an integral part of the travel package program (hereinafter: the package) and therefore also of the Travel Agreement (hereinafter: the Agreement) concluded between the travel agency “Sport i putovanja” d.o.o., Ulica Orehovec 3, Samobor, 10435, ID HR-AB-01-08085240 (hereinafter: the Organizer) and the person entering into the agreement (hereinafter: the Contracting Party).

All information and conditions contained in the program and in these General Terms are binding for the Organizer, the Contracting Party, and the service user – the traveler (hereinafter: the Traveler), unless otherwise specified in the Agreement.

2. Applications for travel packages may be submitted via email or online. Based on the received application, the Organizer will provide the Contracting Party with an Agreement, which becomes binding once signed by both parties or confirmed in another clear manner (internet, fax, email, providing credit card details, payment to bank account). The Agreement produces legal effects once the Organizer receives the agreed payment within the specified deadline. Unless stated otherwise in the program, a 30% deposit must be paid when concluding the Agreement, with the remaining amount due no later than 41 days before departure. The Organizer and Contracting Party may agree on different payment arrangements in the Agreement.

3. The content of the package and its price include all services listed in the program. Special or additional services (transfers, extra meals, optional excursions, entrance tickets, visa services, vaccinations, travel insurance, tips, etc.) not included in the package price may be arranged by the Organizer and included in the Agreement for an additional charge. If the price of requested services is not listed in the program, the Organizer will inform the Contracting Party before the Agreement is concluded.

The Organizer is not responsible for additional services arranged directly by the Traveler during the trip. If required, the Contracting Party must pay in advance certain taxes, fees, or entrance charges determined by regulations and collected by the Organizer on behalf of third parties.

4. Accommodation facilities, restaurants, transport services, and other services are described according to the official categorization of the local tourism authority or relevant body at the time the program was published. Standards of accommodation, food, and services vary between destinations and countries and are not directly comparable. Information obtained verbally or from unauthorized persons does not bind the Organizer beyond what is stated in the program, these General Terms, and the Agreement.

5. The Organizer is not responsible for printing errors or subsequent changes in promotional materials or programs that were communicated to the Contracting Party before the Agreement was concluded. In such cases, the Agreement takes precedence over promotional materials.

6. The Organizer is not responsible if certain activities or services dependent on weather conditions or natural phenomena (lack of snow, sea temperature, rainfall, insects, jellyfish, etc.) cannot be realized as expected.

7. If the Contracting Party has not specifically requested a particular accommodation unit (room, apartment, cabin, etc.), they will accept any officially registered accommodation unit in the selected facility. Accommodation check-in usually takes place between 16:00 and 20:00, and check-out is generally by 10:00 on the final day unless otherwise specified. If arrival or departure times do not match accommodation schedules, the Organizer will attempt to arrange luggage storage but cannot guarantee it. Special requests (pets, extra beds, baby cribs, room orientation, floor, etc.) will be attempted where possible but cannot be guaranteed.

8. If the Contracting Party has booked a “last minute” arrangement or a travel arrangement where the accommodation name is revealed only upon arrival (e.g., Fortuna, Joker, Roulette, No Name Hotel), they accept the risks associated with such travel conditions. Due to the reduced price and uncertainty involved, neither the Contracting Party nor the Traveler may file complaints regarding these arrangements.

9. Package prices are published in Croatian kuna (HRK) and are valid from the date stated in the program. The Organizer reserves the right to increase the price up to 20 days before departure if there are changes in exchange rates, transportation costs (including fuel), or service fees (airport taxes, port charges, etc.). The increase will correspond proportionally to the change in those cost factors.

10. The Organizer may cancel the package or modify the program due to extraordinary circumstances beyond its control (war, civil unrest, strikes, terrorist acts, epidemics, natural disasters, traffic incidents, government interventions, changes in transport schedules, delays in transportation, weather conditions, etc.). The Organizer may also change the departure time or route due to such circumstances without liability for damages.

The Traveler will be informed promptly of any changes. The Organizer is not responsible for transport delays or related program changes and additional costs. If accommodation becomes unavailable at the destination, the Organizer will arrange equivalent or higher-category accommodation at its own expense.

11. If the Contracting Party or Traveler cancels the trip, the Organizer retains the following cancellation fees from the total price:

  • Up to 61 days before departure: 10% of the package price (minimum 100 HRK)
  • 60–41 days before departure: 25%
  • 40–31 days before departure: 40%
  • 30–25 days before departure: 80%
  • 24–0 days before departure: 100%
  • After departure: 100%

If the actual damages exceed the above amounts, the Organizer may charge up to 100% of the package price. These cancellation fees also apply to changes in departure date, accommodation, or other significant elements of the package unless otherwise stated. Visa costs, insurance, vaccinations, and similar expenses are non-refundable.

If the Contracting Party finds a replacement traveler for the same reservation, the Organizer will charge only the administrative replacement costs (100 HRK) if replacement is possible.

For closed group travel, different cancellation conditions apply:

  • Up to 61 days before departure: 50% of the package price retained
  • Up to 41 days before departure: 100% retained

12. The Traveler must ensure that their travel documents comply with carrier requirements and border, customs, health, and other regulations of the countries visited. The Organizer is not responsible if authorities deny transport, visa issuance, or entry into a country. Costs arising from such situations are borne by the Traveler.

13. According to regulations, the travel agency staff must provide the Contracting Party with promotional materials and these General Terms in written or electronic form and inform them about border formalities, visa requirements, and health regulations related to the trip.

14. For packages including organized transport, luggage allowances are:

  • Charter flights: up to 15 kg
  • Scheduled flights: up to 20 kg
  • Bus transport: two standard bags

Excess luggage is paid directly by the Traveler according to the carrier’s rules. Children under two years old do not have luggage allowance. The Organizer is not responsible for lost, damaged, or stolen luggage.

15. If services from the travel package are incomplete or of poor quality, the Traveler must immediately report the issue to the Organizer’s representative or service provider at the destination so that it may be resolved. A written complaint must be submitted within 8 days after returning from the trip, together with supporting documentation.

16. In the event of insolvency or bankruptcy of the Organizer, travelers currently on a trip or those who have paid deposits must immediately contact the insurance company listed in the Agreement.

17. These General Terms are an integral part of the Agreement concluded between the Contracting Party and the Organizer SPORT I PUTOVANJA d.o.o.. Any deviations must be clearly stated in the travel program or Agreement. By signing the Agreement, the Traveler confirms acceptance of the program and these General Terms. This version supersedes all previous versions.
